How to Submit a DMCA Takedown Notice

Under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), your written notification must include the following:

  1. Signature: A physical or electronic signature of the copyright owner, or a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed. If your notice covers multiple works, you may provide a representative list.
  3. Identification of the infringing material: A description of the material you claim is infringing and information reasonably sufficient for us to locate the material on our Service (e.g., a URL or order/song reference number).
  4. Your contact information: Your name, mailing address, telephone number, and email address.
  5. Good faith statement: A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy statement: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Counter-Notification

If you believe that material removed or disabled as a result of a DMCA takedown notice was not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or pursuant to law to use the material, you may submit a counter-notification to our DMCA Agent at the address above.

Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or the District of Minnesota if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Repeat Infringer Policy

In accordance with the DMCA, SongSake will terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers.
